Terms and conditions

Allgemengwuel Agence (www.agw.lu; hereinafter "AGW"), an initiative by Gregor Waltersdorfer Solutions, registered at 2, am Kiesel; L-4980 Reckange-sur-Mess, provides the functionality of the app GoodCompanies.Zone (hereinafter "app") and the required support, and if chosen by the users, i.e. a company representatives who want to create and publish sustainability reports about their companies or employers, (hereinafter "user"), AGW also provides additionally services, which are tutorial videos, video calls, and writing full sustainability reports.
When using the app, users agree to the terms and conditions on this webpage and to ECG's Code of Conduct. With registration and completion of the registration process in the app (email address verification), the terms and conditions are agreed.
For creating a company profile, the user needs to provide the company name, its website, its sales tax ID, a billing address and its number of employees. A company profile can have up to 5 users and needs to have a paid subscription, i.e. a monthly or yearly recurring payment, in order to be able to create sustainability reports. Only the user, who created the company profile (hereinafter "super user"), can add and remove users to and from the company profile, pay and cancel subscriptions, edit and delete the company profile, start new reports, and request audits.
The date the subscripton was paid defines the billing period, which is one month or one year. The super user can cancel the subscription any time, which will then automatically end at the end of the billing period.
The app forwards the company profile data to the payment provider Stripe.com, which calculates the correct tax rate for the subscriptions, and which generates the invoices.
Stripe.com checks if the super user has provided a valid sales tax ID. AGW checks if company name and website match.
All other data that the app asks its users for compiling sustainability reports is voluntary and will be published.
It is the super users' responsibility to ensure that their data (user profiles, company profiles, report data) is correct.
By submitting login data in the app, the user accepts and confirms that the app may use the contact data provided to send the user newsletters with information related to the functionality, the service and other companies using the app by email. The user has the right to object to this type of communication at any time. AGW will process such applications immediately.
AGW reserves the right to include external service providers, i.e. consultants and auditors, to offer their services through the app.
AGW endeavors to avoid excessive downtime (e.g. maintenance and/or updates of the app), waiting times and/or significant impediments to the usability of the app as far as possible, but does not guarantee error-free and uninterrupted accessibility and usability the app or the functions contained therein. In particular, AGW does not guarantee the availability of external service providers. Interruptions or disturbances in the availability of the app must be reported immediately to the app's support at support@goodcompanies.zone.
Errors and/or faults will be remedied by AGW by way of supplementary performance. However, if troubleshooting or supplementary performance is not possible or if AGW is not able to remedy the defect or supplementary performance within 30 days of receipt of the notification of the breach of duty, the user has the right to take other remedial measures in accordance with the law serve.
The app runs on smartphones, tablets and desktops. The users must ensure that their devices meet the minimum technical requirements.
The app, the know-how associated with the app and its functionality, and the copyrights to the software used within the scope of the app are the full and exclusive property of AGW. AGW reserves the right to use the property exclusivly. Any reproduction, modification and/or other use of this property not expressly authorized by AGW is prohibited.
The user is prohibited from reproducing, copying, imitating, technically analyzing and/or modifying the app or its contents in any way and/or creating derivative works from it.
Likewise, the user is prohibited from using visual elements of the app separately from the texts arranged in each case or from adopting the texts and using them for other purposes.
In the event of a violation of the app's terms and conditions, AGW reserves the right at any time, without restriction and without warning, to block or terminate the user and to take legal action, in particular to demand injunctive relief and damages.The user can request the deletion of the registration data at any time and terminate the contractual relationship with AGW if and to the extent that the settlement account has been fully settled and reimbursements to the user are excluded.AGW reserves the right to change the scope and functions of the app as part of the continuous development of the functionality of the app and/or products and services of third parties without amending these terms and conditions, provided that these changes do not affect the quality of the app or the service described herein.
AGW reserves the right to make reasonable changes to the app's terms and conditions. The user can object to the changes 30 days after notification by AGW, otherwise the changes are considered accepted. AGW reserves the right to terminate the contractual relationship with the user in the event of an objection.
All personal data that the user transmits via the app are subject to the app's privacy policy.

Privacy policy

The app goodcompanies.zone (hereinafter "app") is run by Allgemengwuel Agence (hereinafter "AGW"). The app requires the email addresses of users for their authentication. No other personal data is stored.
AGW reserves the right to use data and payment processors for booking video calls and managing subscriptions to whose the app forwards the contact details of the super user's company profile. All data and payment providers are GDPR compliant.
Next to AGW, the data and payment processors, only the users associated to a company profile have access to the users' email addresses.
